Terms and Conditions - Rights Managed (RM) Images - Non-Exclusive
These Terms and Conditions serve as a non-transferable contract (also referred to as an "Agreement") between you (the person viewing this website and using the Images) and Hélène Alexandre.
Please read the following terms and conditions which apply to all users before accepting them and before you continue to use this website or download any Image for reproduction.
All content produced or made available on this website, including, but not exclusively, the texts, graphics, and photographs, (the "Content”) is the property of Hélène Alexandre and the content providers.
If you are a registered user, you may share Images from this website on social media or send them to your computer desktop by e-mail for initial viewing in preview layouts.
This is the ONLY permissible reproduction rights granted by Hélène Alexandre to you for the low-resolution Images.
Barring express authorization set out in this agreement or in another agreement undertaken with Hélène Alexandre, no part nor any element of this website or its content may be copied or transferred by any means whatsoever. This website, its content, and all rights relating to it will remain the exclusive property of Hélène Alexandre except where there is another express arrangement.
Use of Immagia.com site:
In order to have access to all the features of www.immagia.com and download from this site, you must create a “User” account and provide accurate and complete personal information such as your name, your address and the information relating to invoicing. You will be responsible for tracking all activity for your account, and you agree to maintain the security of your password and username.
Rights of use and conditions of digital files:
- Rights Managed (RM) License:
When a user license is granted by Hélène Alexandre, use of the Image is specified on the invoice and cannot be used for any other purpose without the prior authorization of Hélène Alexandre. The license is granted for a single publication and limited to the usage, period of time, print run, reproduction size of Image, territory and other restriction specified in the invoice. A license granted by Hélène Alexandre does not in any way constitute a declaration of compatibility of use of this image with other content.
Purchasing Images on www.immagia.com does not grant you any intellectual property right on the photographs. You only purchase the right to use them.
Hélène Alexandre gives no rights or warranties with regard to the use of names, trademarks, logotypes, registered or copyrighted designs or works of art depicted in any Image. It is the sole responsibility of the Customer to ensure that all necessary rights or agreements, model releases, property releases, permissions or consents which may be required for Reproduction are obtained.
No valid model, property or other releases exist on this site unless the existence of such releases is mentioned with the Image. This mention does not guarantee you a total use of the Image. For any commercial use (displays, advertising…) and/or when the people, monuments or goods on the Image are identifiable, it is your responsibility to obtain further written authorization.
If you choose to receive high-resolution Images in a digital format for reproduction it shall be presumed by Hélène Alexandre that the Images sent by link to you or downloaded by you from this website, have been received in useable and good condition unless you notify Hélène Alexandre otherwise within 7 business days of receipt of the Image files.
Restricted Uses:
Without limitation, Images may not be used as a trademark or service mark, or for any pornographic use, unlawful purpose or use, or to defame any person, or to violate any person's right of privacy or publicity.
Unless additional rights are specified on the invoice or order, you may not use content marked “editorial” for any advertorial, commercial, promotional advertising or advertising purpose. Images shall not be manipulated or altered, added to, or have any part deleted without prior written consent by Hélène Alexandre.
Rates and Payments:
All licenses to use an Image are subject to payment. The cost is based on the definition of use of the image. It will be calculated by criteria such as the number of copies, the type of medium, the areas of distribution, and whether the use requested is exclusive or not and according to the information provided by the license holder. False information may trigger a surcharge in relation to the contract established and may even lead to cancellation of the contract.
The prices are in euros (VAT non applicable - Art. 293 B du CGI) and payments are made in euros. If the payment is made in other currencies, those will be converted into euros with the current exchange rate at the time of the download.
Payments on this website may be made by bank transfer (if you choose this option, your bank may charge a fee) or credit / debit card through Paypal to Hélène Alexandre. You do not need a Paypal account to pay with Paypal. Your personal data is protected and encrypted. There are no fees. Credit card info is transmitted only to Paypal, Hélène Alexandre/Immagia has no access to it.
Depending upon the payment method, you may either download high-resolution digital copies directly from this website or receive a link by email to the download.
An invoice (Note d'auteur) will be issued and sent to you electronically within 5 working days and payable within 30 days.
After a reproduction fee has been agreed and an invoice/license issued and paid by you, you are granted specific reproduction rights and you may then use the Images, subject to these Terms and Conditions. You only have the right to reproduce an image when the invoice/license is paid in full.
Any delay of payment will involve late penalties, at the statutory rate in effect (Article L 441-6 of the Commercial Code). To these penalties, an allowance of 40 euros will be added (Article L 441-5 of the Commercial Code).
You may use the images licensed to you on a non-exclusive basis for the specific uses and purposes stated on the invoice and limited by these Terms and Conditions.
No additional usage, new use or reuse in any form may be made of any Image without first contacting Hélène Alexandre to purchase additional rights.
Credits and published Images:
For editorial use, with any publication of an Image under licence, Hélène Alexandre/Immagia.com must be credited in all reproductions of its work. The credit line must contain "Hélène Alexandre/Immagia.com". The preferred position for the credit is to the side of the Image or in the photographic acknowledgements and credits section.
For non-editorial use, you agree to provide copyright protection by placing proper copyright notice on any use.
Hélène Alexandre/Immagia asks to receive at least a copy and/or a link to any publication containing a reproduction of an Image.
Data protection:
In France, personal data is protected by the law n ° 78-87 of January 6th, 1978, the law n ° 2004-801 of August 6th, 2004, the article L. 226-13 of the Penal Code and the European Directive of the October 24, 1995. By using the site www.immagia.com, the URL of the links through which the user has accessed to the site, the supplier of user access, the Internet Protocol (IP) address of the user can be collected.
